Black Male Success™ Terms of Service (TOS)

Welcome to Black Male Success™ (“Black Male Success,” “we,” “our,” or “us”). Black Male Success is a for-profit educational and mentorship platform developed and operated by Black Male Success LLC, and powered by the Black Doctoral Network, Inc., a registered 501(c)(3) nonprofit organization. These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.

1. Eligibility

You must be at least 18 years old to use the Services. We do not knowingly allow individuals under the age of 18 to register, access, or use Black Male Success. By using the Services, you represent and warrant that you meet this requirement.

2. Account Registration

To use certain features, you must create an account and provide accurate, complete information. You are solely responsible for safeguarding your login credentials and for any activity occurring under your account.

We reserve the right to suspend or terminate your account if any information is inaccurate, misleading, or violates these Terms.

3. Description of Services

Black Male Success provides access to mentorship networks, educational content, curated community experiences, and related tools and services. We do not guarantee any specific outcomes from participation.

Mentors featured on the platform are independent individuals and are not employees, agents, or representatives of Black Male Success. We are not responsible for their actions, advice, or conduct.

4. Code of Conduct

When using our Services, you agree not to:

• Use the Services for unlawful or malicious purposes
• Harass, threaten, or harm others
• Impersonate any individual or organization
• Upload viruses, malware, or other harmful code
• Interfere with or disrupt the integrity of the Services
• Violate any local, state, or federal laws

Violations of this code may result in immediate suspension or permanent termination of your account.

5. Intellectual Property

All content on Black Male Success, including text, graphics, branding, designs, and software, is the property of Black Male Success or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, reproduce, republish, or distribute any content from the Services without prior written permission, except for personal, non-commercial use.

6. Third-Party Services

The Services may contain links to or integrations with third-party websites, tools, or platforms. Black Male Success is not responsible for the content, terms, privacy practices, or functionality of any third-party services. Use of those services is at your own risk.

7. Disclaimers

The Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We disclaim all express and implied warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

8. Limitation of Liability

To the fullest extent permitted by law, Black Male Success and its affiliates shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Services.

Our total liability for any claim under these Terms shall not exceed one hundred U.S. dollars (US $100).

9. Indemnification

You agree to indemnify, defend, and hold harmless Black Male Success, its officers, directors, employees, affiliates, and partners (including the Black Doctoral Network, Inc.) from any claims, liabilities, damages, or expenses resulting from your use of the Services or your violation of these Terms.

10. Privacy

Our use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Modifications to Terms

We may modify these Terms at any time. Changes will be posted on our website and updated with a new effective date. Continued use of the Services after such changes indicates your acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of courts located in Delaware for any legal disputes.

13. Organizational Structure

Black Male Success™ is operated as a for-profit initiative under Black Male Success LLC and is powered by the Black Doctoral Network, Inc., a nonprofit organization committed to educational equity, mentorship, and advancement of underrepresented communities. While affiliated with the Black Doctoral Network in mission and partnership, Black Male Success operates independently and is financially and legally distinct.
